The court said Freshwater can argue it is unconstitutional to fire someone without clear guidance on what teaching materials or methods are acceptable. Freshwater also can argue it is unconstitutional to fire someone over the mere presence of a religious text such as the Bible in a classroom-

’Without clear guidance…’ Seems the teacher has a case. If there is no law against his method, it seems disingenuous to rid him of a non-offense’ Kind of like the excellent reference: ‘where no law is, there is no transgression.’

One charge is ’the mere presence of a bible in the classroom.’ Yes, scary, the book might jump up and strangle kids, or turn them into radishes!

Now it’s time to defend the inevitable comments about ’church and state’ and here is the correct question that is never asked: In a teaching environment, WHAT CHURCH is represented when a teacher puts forth the idea of a world created by God? Take your time, ponder your answer.

This is a fair question, and if the naysayer attempt to ‘lawyerly’ dismiss this as lunacy with an answer that requires mental gymnastics, I’ll repeat: ‘What CHURCH is represented when a teacher puts forth the notion of a world created by God?

Seems the teacher here is not unreasonable, and true learning after all is examining ALL the evidence, no?

However, if the teacher starts preaching about sin, judgment, the world to come, a case could be made against him. It does appear this teacher had trouble in the past with a usurpation of his classroom, but this does not seem to be the charge now. He has been accused of teaching ‘creationism’ in a public school.

Would any body argue if an atheist taught the possibility of creation? Would there be an out cry in the streets? I doubt it, for the issue is one of ‘christian intolerance.’ But learning, true learning, should include the examination of all evidence and points of view. If something is true, it can withstand the most serious of scrutiny, and this is where the ‘theories’ stand or fall.

Go ahead and teach evolution, that does not frighten a learned mind. Go ahead and put forth the idea of a Creator, that too should be equally well received.  Please do not confound this topic by hiding behind ‘church and state,’ as there is no church represented when one says ‘in the beginning God.’

This only alarms an immature mind.
